Chapter 7: Liquidation

Chapter 7 is also known as 'Fresh start bankruptcy' or 'Liquidation bankruptcy' and generally allows you to eliminate most of your unsecured debt. Through Chapter 7 bankruptcy, you can ask the bankruptcy court to discharge any and all debt allowed by law, including credit cards, medical bills, personal loans, late charges, and penalties.

Chapter 13 is also known as 'Wage earner bankruptcy' or 'Reorganization bankruptcy'. To stop any foreclosure in a chapter 13, you need 0$ filing fee. Chapter 13 bankruptcy generally allows wage earners to surrender the secured property they wish to surrender and keep the secured property they wish to retain. In the latter case debtors must keep up with the payments on the property they choose to keep (usually home or car). However, back payments can be placed in a plan to be repaid over time, in accordance with the debtor's budget.
